⚖️ API Terms and Conditions

The CarJam Online Limited ("CarJam") API is made available to you on the following conditions. Your or your application's use of the API constitutes your acceptance of these terms.

You agree to ensure your application doesn't do anything that could cause any end user of your systems to breach these terms and conditions or any other of Carjam's terms and conditions.

You agree not to use your users' access to the API for your own purposes, or for any purpose other than carrying out your end users' requests for data compliant with all applicable laws.

You agree not to do anything on behalf of an end user that has not been clearly authorised by that end user.

We may impose limitations on or block your application's access to the API at any time if you breach these terms, or at our sole discretion.

Accuracy and compliance

You must ensure that any information your application sends us is accurate and that you have the right to send it to us and for us to use it. For example: any requests for personal information from the Motor Vehicle Register ("MVR") made on behalf of a member must meet the appropriate legislation requirements described elsewhere in CarJam terms and conditions.

You may not use data in a way that is illegal or misleading or that breaches any of CarJam's terms and conditions or infringes others' rights, or that facilitates or assists members to breach any of CarJam's terms and conditions or any law, or infringes others' rights.

If you enable end users to engage in commercial dealings via any system based on CarJam data then you agree to display all information available that is required by relevant laws - e.g. Consumer Information Notices where available for cars and not disseminate any personal information outside the specific purposed defined by legislation.

Privacy

In dealing with your users' information, you agree to comply with the Privacy Act 1993, and your own privacy policy. If you do not publish a privacy policy, you agree to comply with ours.

You agree to only use the data including personal information from the Motor Vehicle Register we provide you to enable your application, and to delete it when no longer required for your application, or if we terminate this agreement.

Operational Behaviour

You agree to act responsibly and professionally, to test all systems and software, and don't do anything to put CarJam systems, the MVR or personal information from the MVR at risk.

Intellectual property

Intellectual property retrieved through the API remains the property of CarJam or our members, as the case may be. We ask you to respect that, and only use the information obtained through the API for purposes clearly authorised by us.

We reserve the right to develop and run an application similar to or in competition with yours.

Updates to the API and these terms

We will continue to update the API from time-to-time and may not notify you when we do. Although we'll do our best to avoid making 'breaking-changes', sometimes the changes we do make may result in you needing to make changes to your application at your own cost.

We will continue to update these terms as our API evolves and developers come up with new ways to use it. When we do this, we will update the terms here in our help pages, and may make a site announcement directing you to the updated version. Your or your application's continued use of the API will constitute your acceptance of the updated terms.

Restrictions on Use

The Developer Connection Data shall be used by Customer solely for its internal purposes and shall not be resold or otherwise disclosed to any third party without the prior written consent and agreement of pricing with CarJam, and Customer shall not copy, decode, reverse engineer (including data acquisition by “screen scraping”) or use the Product for any other purpose. Customer shall not place the Products or derivatives of the Developer Connection products on the Internet or any similar network service without a prior written agreement with CarJam.

Access Methods

You may not access CarJam APIs or our website using tor end points or similar anonymising software. You may not access CarJam using software which exposes CarJam API keys on a public facing server.

Restrictions on Ownership Use for Authorised Entities

Authorised Developer Connection users may only access personal information from the Motor Vehicle Register for a specified purpose, as described for each class for which the Ministry of Transport have granted access: Registered Motor Vehicle Traders, Registered Financial Services Providers and Service Stations and with written approval regarding access control methods from CarJam

Recognition

All systems making use of Products by way of physical, visual, electronic or verbal delivery of Report or Developer Connection or other data from CarJam to deliver information to 3rd parties, customers or for internal use within a customer organization must be clearly marked with “Data supplied by CarJam – carjam.co.nz” as appropriate to be recognisable in the format of delivery e.g. visible on any user interface presenting such data in any form.

Security of your connection credentials

You are responsible for keeping your Developer Connection authentication key, secret and secure. Without limiting the foregoing, you agree: not to permit any other system operator, business entity or individual person to use your authentication key; and not to disclose, or provide to any other person, business entity or system operator any other information in connection with your Developer Connection that may allow them to gain access to your membership.

Payment and Pricing

You agree to pay the prices set per API product as defined by CarJam administrators prior to your use of the system. Use of the API products constitutes acceptance of these prices. Payment will be in accordance with commercial terms agreed between you and CarJam e.g. due dates, pre-payment or post-payment of fees as agreed before use of the API. use of these API products constitutes acceptance of those commercial terms. CarJam reserve the right to modify the pricing of all products and will wherever possible attempt to provide 1 months notice of such changes excepting due to changes in pricing of 3rd party data utilised by API products

General

We make absolutely no warranties about our API, the data we provide you, or their continued availability.

Any and all liability and responsibility of CarJam to you or any other person under these terms and conditions, or in connection with the API, is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise. CarJam's liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.

You agree to release, indemnify and keep indemnified us from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of or in connection with your failure to comply with these terms and conditions, your application, or any use of your application.

CarJam's website terms and conditions form part of these API terms and conditions and shall (with all necessary modifications) apply so far as is possible to these terms. In the event that there is any conflict between these terms and the CarJam website terms, these terms shall prevail.

These terms and conditions are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the Courts of New Zealand.
